YOU HEREBY AGREE THAT ALL DISPUTES ARISING FROM, RELATED TO, OR IN CONNECTION WITH YOUR USE OF THE SERVICES WILL BE RESOLVED IN ACCORDANCE WITH THE ARBITRATION AND GOVERNING LAW PROVISIONS SET FORTH BELOW.

We reserve the right, at our sole discretion, to modify these Terms at any time and without prior notice. If we modify these Terms, we will post a notification of the modification on our website. The date of the last modification will also be posted at the beginning of these Terms.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any defects will be corrected.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUNATISCALE.AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES.
8. Termination
We may suspend or terminate your access to the Services at any time, with or without cause or notice, including if we believe you have violated these Terms.
Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.
9. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved amicably. If not resolved, disputes shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The seat of arbitration shall be Pune, Maharashtra, India. The language of arbitration shall be English.
Subject to the arbitration clause above, the courts at Pune, Maharashtra shall have exclusive jurisdiction.
